Scope and Contracting Parties
1.1 These General Terms and Conditions (GTC) apply to all contracts between Barrierenlos℠ (hereinafter: "we" or "us") and our customers (hereinafter: "Customer" or "You") who use our services, products, and offers. This includes both paid and free services.

Service Description
We offer various services in the field of website accessibility. The conditions relevant to the product you purchased can be found in the corresponding sub-section.
Our services and products include the following:
Free BFSG Relevance Check
We provide you with a short questionnaire (8 questions) to assess whether your company is affected by the new BFSG (Barrierefreiheitsstärkungsgesetz - Accessibility Strengthening Act). This check is free of charge and serves only as initial guidance. Legally binding information is not provided.
Liability: Any liability for the accuracy, completeness, or timeliness of the check is excluded.
BFSG Checklist
We offer extensive PDF documentation with all relevant information on the BFSG for website developers. This includes a checklist for conducting a self-audit. The checklist is available in two versions:
- BFSG Checklist without Consulting: You receive the PDF document and the checklist for independent application.
- BFSG Checklist with Consulting: In addition to the PDF document, you receive an extra individual consulting session to clarify questions about the checklist and BFSG implementation.
14-Day Money-Back Guarantee: If you are not satisfied with the checklist, you can withdraw from the contract within 14 days. If you have downloaded the checklist, you are obliged to delete it and not use it further.
License: The checklist is distributed under the license Creative Commons Attribution – Non-commercial 4.0 International (CC BY-NC 4.0). This means you may use and share the content for non-commercial purposes, provided you credit us as the author.
Liability: Any liability for timeliness, completeness, or success in applying the checklist is excluded.
BFSG Audit
Here, we conduct a comprehensive manual review of your website for accessibility and create a detailed To-Do list and a report to recommend specific improvement measures. The audit is carried out according to the BFSG guidelines in accordance with WCAG 2.2 A and AA. The audit is available in two versions:
- Audit without Consulting: You receive the audit report and the To-Do list but implement them independently.
- Audit with Consulting: In addition to the report, we offer a consulting session where you can clarify implementation questions. You must utilize the consultation within 30 days of purchase. After that, it expires.
White-Label Service: You may pass on this audit as your own service to your end customers, provided these end customers are not professional website developers. Resale to other developers or agencies is excluded.
14-Day Money-Back Guarantee: In case of dissatisfaction, you can withdraw from the contract in writing within 14 days. You are obliged to delete the audit report and the To-Do list and not use them further.
Liability: No liability is assumed for any misjudgments or implementation errors. Liability is excluded.
BFSG Cost Calculator
A free online tool that provides a rough cost calculation for BFSG implementation based on a few details. The calculation is based on generic criteria and can vary greatly individually.
Liability: This calculator serves only as initial guidance; no binding statement is made regarding the actual costs. Thus, any liability is excluded.
Implementation of Website Accessibility
We analyze your website in detail and create a comprehensive action plan to adapt it to the requirements of the BFSG according to WCAG 2.2 A and AA. You can find WCAG 2.2 at https://www.w3.org/WAI/standards-guidelines/wcag/.
The assignment is made after individual consultation, whereby a flat rate is charged per unfulfilled criterion. A precise cost estimate will be provided before the contract is concluded.
Liability: We do not guarantee that the finally implemented website will permanently comply with all current or future legal requirements. Our liability is excluded.
BFSG Consulting
A one-hour consulting session in which we explain the most important aspects of the BFSG, answer technical questions about website accessibility, and provide tips for preparing an accessible website. This consultation is subject to a fee. After purchase, you will receive a link to schedule an appointment. You must utilize the consultation within 30 days of purchase. After that, it expires. A money-back guarantee does not exist.
Liability: The consultation does not substitute for legal advice. Any liability for the success or legal certainty of your implementation is excluded.
Free Express Audit / Cost Estimate
Within 2 working days, we conduct an Express Audit and create a non-binding cost estimate for accessible redesign. This serves only as an initial assessment – Liability for accuracy and completeness is excluded.
Semanticality™ for WordPress Gutenberg (Plugin)
A plugin developed by us with which developers can rule-based adjust the final HTML output of Gutenberg blocks (including tag changes, adding/removing/extending attributes, global and local rules, access to WP-Meta, generation of unique IDs, live preview). Processing takes place server-side (including via Symfony/Component/DomCrawler) before delivery to the browser.
Important Notes:
- Non-destructive runtime adjustments; no changes to the theme code or stored content.
- Compatible with WordPress core blocks and common block libraries (e.g., Kadence Blocks). Not compatible with page builders such as Elementor or Divi.
- Rules are generally independent of the theme; selectors may need to be adjusted when switching themes.
- Client-side loaded/dynamic scripts can override server-side adjustments.
- The plugin does not automatically make websites accessible; it is a specialized tool for developers.
License Models & Services (Updates & Support):
- Solo: 1 website (Prod & Staging incl.), 1 year of updates + Standard Support.
- Studio: up to 5 websites, 1 year of updates + Priority Support.
- Agency: up to 25 websites, 1 year of updates + Priority Support + 1× 60-min Onboarding Call.
- Enterprise: from 50 websites, individual conditions (e.g., SLA, Private Builds).
Support Quotas per Plan (monthly):
- Solo: max. 2 tickets / month
- Studio: max. 5 tickets / month
- Agency: max. 10 tickets / month
Important: Unused tickets expire at the end of the month. Support includes installation, basic configuration, operation of the plugin, and fundamental questions about digital accessibility (e.g., WCAG/BFSG-compliant use of the plugin). Not included are individual project consulting, legal advice, general WordPress consulting, or resolving conflicts with third-party software (can be separately commissioned).
Note: Purchase, billing, invoicing, and license management for the Semanticality™ plugin are handled by our distribution partner and Merchant of Record, Freemius, Inc. The contractual relationship regarding the acquisition of the license therefore arises with Freemius, Inc. Our performance obligations (e.g., updates, support) also arise from these GTC.

EAA Workshop
We offer a 4-day on-demand workshop ("EAA Workshop: Become an EAA Pro Developer") specifically aimed at developers with prior knowledge of HTML and CSS. The workshop combines standardized learning modules (videos, scripts) with a custom analysis of the website submitted by the customer.
Scope of Services and Procedure:
- Preparation (Custom Curriculum): After the purchase, we will analyze the website specified by the customer within five (5) business days. Based on this analysis, we create a custom curriculum and an "Implementation Roadmap". Access to the learning modules will only be granted after this preparation is complete.
- Learning Modules: The customer receives access to on-demand video modules and written materials on the topics of EAA, WCAG 2.2, semantic HTML, and ARIA.
- Implementation Roadmap: A detailed PDF analysis (comparable to an audit report) for up to five (5) representative pages (templates) of the customer's website. This plan serves as the basis for practical exercises and is to be understood as learning material, not as a comprehensive audit of the entire website.
- 1:1 Strategy Session: A 60-minute live video session to discuss the implementation roadmap and clarify individual questions.
- Email Support: For a period of three (3) months from the date of purchase, we offer email support for technical questions regarding the learning modules. This support is limited to five (5) support requests per customer per month. We strive to respond within three (3) business days (Mon-Fri). The entitlement to support expires after the three months have passed or after the limit of 15 requests has been reached.
Conditions and Deadlines:
- Booking the 1:1 Session: The 1:1 strategy session must be booked and attended by the customer within three (3) months of the purchase date. Unused sessions expire without replacement.
- Prerequisites: The workshop requires a solid foundational knowledge of HTML and CSS. It is not designed for beginners without technical experience.
- Final Certificate: Upon full completion of the modules and the 1:1 strategy session, Barrierenlos℠ will issue a digital certificate of completion. This certifies participation and the content covered but does not constitute a state-recognized qualification.
- Bonus (Community Access): The access to the Discord server ("Community") granted as a bonus is a voluntary additional service and not a fixed component of the contract. There is no entitlement to its operation, availability, or support services within the community. We reserve the right to discontinue the community at any time without giving reasons.
14-Day Money-Back Guarantee: If you are not satisfied with the workshop, you can withdraw from the contract in writing (e.g., via email) within 14 days of purchase. In this case, you are obligated to delete all downloaded materials (videos, scripts, implementation roadmap) and to cease using them.
Liability: We do not guarantee a specific learning outcome or the "Pro Developer" status. Liability for the accuracy, completeness, or success in applying the learned content is excluded. The consultation provided does not replace legal advice.
Conclusion of Contract
3.1 The presentation of our offers on the website does not constitute a binding offer but serves as an invitation for you to submit a binding offer.
3.2 A contract is concluded when we expressly confirm your order or request (e.g., by email) or when we begin executing the service. For free services such as the relevance check or the BFSG cost calculator, there is no claim to their continuation.
3.3 When acquiring Semanticality™ licenses, the contract for the purchase and handling is concluded with Freemius, Inc. You will receive the license information (e.g., license key/download) immediately after purchase. The contract for digital content begins with the provision of the digital service. Our obligations regarding updates and support arise from Section 11 of these GTC.
Rights of Use and Creative Commons Licenses
4.1 Where indicated, the BFSG Checklist is under the Creative Commons Attribution – Non-commercial 4.0 International (CC BY-NC 4.0) license. You may use the content for non-commercial purposes and share it with attribution. Any commercial use or redistribution is prohibited unless we have expressly agreed in writing. Changes to the document may only be made if the resulting work is distributed under the same license terms.
4.2 For BFSG Audits, Consulting, or Implementation Services, we grant you only the right to internal use. You are not entitled to further rights of use and exploitation unless we have expressly permitted this in individual cases (e.g., within the scope of the white-label offer).
4.3 The special license and usage conditions according to Section 11 apply to the Semanticality Plugin.
Prices, Payment Modalities, and Money-Back Guarantee
5.1 The prices of our paid offers are specified in the respective service descriptions or in the ordering process. Promotional/introductory discounts (e.g., launch discount) apply only for the period mentioned there and are considered during the ordering process.
5.2 Payment Methods:

For our services (e.g., Audits, Consulting, Implementation, Checklists), we offer the payment methods specified in the ordering process (e.g., Stripe/Credit Card, PayPal, Bank Transfer, Direct Debit).

For the acquisition of Semanticality™ licenses, payment processing is handled exclusively by Freemius, Inc. with the payment methods offered there. Invoicing is done by Freemius.
5.3 A 14-day money-back guarantee applies to certain services (e.g., BFSG Checklist, BFSG Audit). For Semanticality™ licenses, the refund policy of Freemius, Inc., which is displayed to you during the ordering process, applies.
5.4 Renewals/Upgrades/Downgrades Semanticality™: Licenses that include updates and support can be renewed after expiry at the respective current conditions. Upgrades and downgrades are possible via Freemius. Upgrades are usually prorated taking into account the remaining term; downgrades become effective at the end of the current billing period. Billing, possible refunds, and term adjustments are made according to the terms of Freemius.
Liability and Warranty
6.1 Free Services (e.g., Relevance Check, BFSG Cost Calculator, Free Express Audit) are provided without any liability or warranty. They merely serve as non-binding guidance.
6.2 Paid Services: We are only liable for intent and gross negligence or for the breach of essential contractual obligations. In the event of slightly negligent breaches of these contractual obligations, our liability is limited to the foreseeable, typical contractual damage. We assume no liability for consequential damages, lost profits, or damages to third parties.
6.3 We expressly point out that legal and technical requirements (e.g., WCAG, BFSG rules) may change. We cannot guarantee permanent topicality and legal conformity.
6.4 We assume no liability for violations of the White-Label Agreement (e.g., resale to developers). The Customer is obliged to pay compensation in such cases if we incur damage due to the breach of contract.
6.5 Semanticality Plugin: We do not warrant that the plugin will function error-free in every conceivable system/theme/plugin combination. In particular, we assume no liability for impairments caused by third-party client-side scripts, individual code adjustments, incompatible page builders (e.g., Elementor, Divi), or future WordPress/PHP versions without ongoing update authorization. Performance or speed measurements may vary depending on hosting/setup. Support is provided exclusively within the quotas defined in Sections 2.8 and 11 and the scope of services described therein.
White-Label Service and Exclusion of Resale to Developers
7.1 Where agreed (e.g., for the BFSG Audit), you may resell our audit report under your own label to end customers, provided they are not professional website developers. This right is limited to end customers who request your service, not to other agencies or developers.
7.2 Resale or transfer to customers who themselves develop websites is expressly excluded. We reserve the right to assert claims for damages and to terminate the contractual relationship without notice in the event of violations.
Customer Obligations to Cooperate
8.1 You must timely provide all necessary information, data, and, if applicable, access credentials so that we can properly perform our services. This may include, for example, server access, technical documentation, or project-related information.
8.2 Delays and additional effort caused by missing or delayed cooperation are not our responsibility. We may charge for the resulting additional effort accordingly, provided we have informed you beforehand.
Right of Withdrawal for Consumers
9.1 If you are a Consumer within the meaning of Section 13 BGB (German Civil Code) and purchase a paid product in our online shop, you may be entitled to a right of withdrawal. For digital content that is not supplied on a tangible medium, you may lose this right if you expressly consent before the service is executed and confirm that you lose your right of withdrawal.
9.2 We inform you about the exact conditions of the right of withdrawal in the ordering process or in a separate withdrawal instruction. The 14-day money-back guarantee (cf. Section 5.3) exists independently of this, provided it is assured for the respective product.
9.3 For the acquisition of Semanticality™ licenses, the withdrawal and refund conditions of Freemius, Inc., which are communicated to you during the ordering process, apply.
Data Protection
10.1 Information on the handling of your personal data can be found in our Privacy Policy. We generally process your data only within the framework of the applicable data protection laws of the EU and Germany.
10.2 If you pass on our results or tools (e.g., white-label audit, plugin licenses) to your own customers, you are obliged to also comply with the relevant data protection regulations and inform your customers accordingly.
Special License and Usage Conditions for the Semanticality Plugin
11.0 Preliminary Note (Merchant of Record): The purchase and license management of the Semanticality™ plugin are handled by Freemius, Inc. (Merchant of Record). The terms of Freemius apply in addition to the purchase process. The following provisions regulate our own performance promises regarding updates, support, and use.
11.1 GPL Compatibility (Code License): The source code of the Semanticality™ plugin is published under the GNU General Public License Version 3 or later (GPL-3.0-or-later). The GPL rights (use, study, modification, distribution) remain unaffected by the license key. The license key provided by Freemius is exclusively for managing access to updates/support and, if applicable, external services.
11.2 Term, Updates & Automatic Renewal: The right of use to the published code is indefinite due to the GPL. The contractual access to Updates and Support is valid for the respective purchased period (usually 1 year) and automatically renews unless terminated in due time. Without an active update/support term, there is no claim to compatibility updates for future WordPress/PHP versions.
11.3 Plans & Services: Solo (1 website), Studio (up to 5 websites), Agency (up to 25 websites), Enterprise (from 50 websites, individual conditions). All plans include 1 year of updates and email support (Solo: Standard, Studio/Agency: Priority; Agency additionally 1× 60-min Onboarding Call).
11.4 Support Quotas (monthly):

11.5 Transferability of Services: The transfer of the plugin code permissible under GPL remains unaffected. The contractual claims to updates/support (license key-bound) are not transferable without our consent. In agency projects, the code may be used within the projects; for updates/support on the customer side, a separate term/license assignment may be required.
11.6 Usage Restrictions (Non-Code Components): Trademarks, logos, product names, provided designs/assets, and separately provided documentation, templates, or cloud services are not under the GPL and may not be copied, rented, leased, publicly made available, or further distributed as a stand-alone product without our consent. The plugin code under GPL is not affected by this.
11.7 Compatibility & Performance Limits: Designed for WordPress Gutenberg blocks; no compatibility with page builders (including Elementor, Divi). Dynamic, client-side manipulations (e.g., by other plugins/themes/scripts) can override server-side adjustments.
11.8 Performance: Adjustments are made server-side before delivery. The impact on loading time is generally minor but can vary depending on hosting, caching, the scope of rules, and page structure.
11.9 No Automatic Accessibility: The plugin provides tools to generate semantically correct HTML code. Automatic fulfillment of WCAG/BFSG requirements is not associated with this; professional configuration and development are required.
11.10 License Compliance: To avoid license misuse, we are entitled to automatically process usage-related data (e.g., domain hashes, license status) to a reasonable extent. Details see Privacy Policy.
Final Provisions
12.1 Applicable Law and Jurisdiction: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant, a legal entity under public law, or a special fund under public law, our place of business is the place of jurisdiction for all disputes.
12.2 Requirement of Written Form: Amendments and supplements to these GTC require written form. This also applies to an amendment of the requirement of written form itself.
12.3 Severability Clause: Should a provision of these GTC be or become ineffective, the validity of the remaining provisions remains unaffected. The ineffective provision shall be replaced by a legally permissible provision that comes closest to the economic purpose.
12.4 Contract Language: The contract language is German. Translations into other languages are for information purposes only and are not legally binding.
These GTC are valid without signature and come into effect upon publication on the website.
